About These Terms

This website, vividoutreachgroup.ca, is operated by Vivid Outreach Group (“V.O.G.”, “we”, “us”), a company operating in British Columbia, Canada. We build AI-powered telephone reception, call routing and appointment booking systems for service and trades businesses.

These Terms of Use govern your access to and use of this website and its content. They do not govern our services. If you engage us, our AI Receptionist Service Agreement governs that relationship, and where these Terms conflict with a signed agreement between us, the signed agreement prevails.

Accepting These Terms

By accessing or using this website you agree to these Terms of Use. If you do not agree with them, please do not use the site.

If you are using this site on behalf of a business, you confirm that you have authority to accept these Terms on that business's behalf.

This Site Is Not an Offer or Advice

Nothing on this website constitutes a binding offer, a quotation, or a commitment to provide services. Pricing, plan descriptions and feature lists are indicative and subject to change. We are bound only by a written agreement signed by both parties.

Nothing on this site is legal, accounting, tax, regulatory or professional advice. We write about privacy obligations, call recording and related subjects because they affect the service we provide — not as guidance you should act on without your own advisor. Your obligations depend on your industry, your regulator and your circumstances.

Submitting a contact form, booking a call or exchanging emails with us does not create a service relationship, and does not oblige either of us to enter one.

Accuracy of What You Read Here

We work to keep this site accurate and current, but we do not warrant that it is free of errors or omissions, or that it is up to date at any given moment.

Where we publish industry figures — missed call rates, revenue impact, response times or similar — they are general industry data or illustrative estimates, not a prediction of your results. Where we describe outcomes achieved for other businesses, those outcomes depend on factors specific to each business and are not a guarantee of what you will achieve. We identify the source of published statistics where one exists, and you should treat any figure without a stated source as an estimate.

You are responsible for verifying anything on this site before relying on it, and for deciding whether our service suits your business.

You may view, browse and print pages of this site for your own business or personal reference.

Enquiries and What You Send Us

When you submit a contact or booking form, or email us, we use what you send to respond and to assess whether we can help. Our Privacy Policy sets out how that information is handled, stored and deleted.

Please do not send confidential, privileged or sensitive information through the contact form or by unencrypted email. Email is not a secure channel, and information sent to us before a written agreement is in place is not subject to any confidentiality obligation unless we have agreed to one separately in writing.

If you send us an idea, suggestion or feedback about our services or this site, you agree we may use it without obligation, compensation or attribution to you. This does not affect any information you send that is personal information about you, which remains governed by our Privacy Policy.

You are responsible for the accuracy of what you submit, and for having the right to send us anything that relates to another person.

Our Intellectual Property

All content on this site — text, layout, graphics, code, images, audio, the Vivid Outreach Group name, the V.O.G. monogram, and our logos and visual identity — is owned by us or licensed to us, and is protected by Canadian and international copyright and trade-mark law.

Nothing on this site grants you any licence or right to use our trade-marks, branding or content, except the limited personal and business reference use described in section 5.

Our voice scripts, prompt design, automation workflows and system configurations are our confidential and proprietary property. Descriptions of them on this site are provided to explain what we do, not to licence their use.

You may not use this site or its content to train, fine-tune or evaluate any artificial intelligence or machine learning model without our express written permission.

If you believe content on this site infringes your rights, contact us at the address in section 16 and we will investigate promptly.

Links to Other Sites

This site may link to websites we do not control, including those of our technology providers and, with permission, our clients. We provide those links for convenience. We do not endorse, and are not responsible for, the content, accuracy, practices or privacy handling of any site we link to. Visiting a linked site is at your own risk and subject to that site's own terms.

Site Availability

We do not promise that this website will be available at any particular time or without interruption. We may change, suspend or withdraw all or part of it, temporarily or permanently, without notice.

This section concerns the website only. Availability commitments for our AI receptionist service, where any exist, are set out in the signed service agreement and are not affected by this section.

Disclaimer of Warranties

THIS WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR THAT IT IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Some jurisdictions do not allow the exclusion of certain warranties. Where that is the case, the exclusions above apply only to the extent permitted by law, and nothing in these Terms limits any right you have that cannot lawfully be limited.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, V.O.G. AND ITS OWNERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITY, LOSS OF DATA OR REPUTATIONAL HARM, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THIS WEBSITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THIS WEBSITE WILL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100).

This section applies to your use of the website. If you are a client, the limitation of liability in your signed service agreement governs our services, and this section does not reduce or replace it.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, or any liability that cannot lawfully be excluded.

Indemnity

You agree to indemnify and hold harmless V.O.G. and its owners, employees and contractors from any claim, loss, liability or reasonable legal cost arising from your breach of these Terms, your misuse of this website, or your infringement of any third party's rights through your use of this site.

This applies to your use of the website only. It does not extend to our provision of services, which is governed by the indemnity provisions of the signed service agreement.

Privacy

Our Privacy Policy forms part of these Terms and explains how we collect, use, store and delete personal information — including information from website enquiries, from our clients, and from people who call businesses using our AI receptionist. We handle personal information under British Columbia's Personal Information Protection Act and the federal Personal Information Protection and Electronic Documents Act.

Changes to These Terms

We may update these Terms from time to time. The effective date at the top of this page shows when the current version took effect. Changes apply from the date they are posted, and your continued use of the site after that constitutes acceptance.

Changes to these Terms do not alter any signed agreement between us. That can only be amended in writing, signed by both parties.

Governing Law and Disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in that province, without regard to conflict of law principles.

You agree that the courts of British Columbia have exclusive jurisdiction over any dispute arising out of or relating to this website or these Terms, and you submit to the jurisdiction of those courts.

If you are a client, the dispute resolution provisions of your signed service agreement govern disputes about our services, and this section applies only to the website.
